Hiring in Puerto Rico? Federal law is only the floor here.

Puerto Rico is US territory, but it runs its own tax and labour system underneath. Getting the employment model wrong here does not just cost time and money, it means untangling two tax authorities instead of one. We help you choose the right way to hire, place you with the right partner, and stay alongside you for the life of the relationship.

US market access. A separate territorial tax system underneath.

Puerto Rico gives you US legal infrastructure, the US dollar, and a deep pharmaceutical and medical-device manufacturing base, but it is not a US state for tax purposes: Hacienda, the Departamento de Hacienda, runs its own income tax system alongside federal FICA and FUTA, and Act 60 layers a further set of incentive rates on top for qualifying businesses. Federal frameworks apply where you would expect them to; Puerto Rico’s own frameworks apply everywhere else.

01

US dollar, US legal system, its own tax authority

No currency risk and US-standard contract and IP law, but Hacienda administers a separate territorial income tax system, not the mainland IRS federal brackets, and Act 60 adds its own incentive rates for qualifying businesses on top of the standard corporate rate.

02

Protective labour law, on a US foundation

Federal statutes like FLSA and FMLA apply, but the Labor Transformation and Flexibility Act (Law 4-2017) and the Unjust Dismissal Act (Law 80) add daily overtime after 8 hours, a mandatory Christmas bonus, and just-cause dismissal protection with no statutory notice period, on top of the federal floor.

Four ways to hire in Puerto Rico. Pick once, pick right.

Most businesses arrive having already decided, and often decided too quickly. Here is the honest version of each route. When one fits, the detailed guide is one click away.

Employer of Record

An EOR partner becomes the legal employer of your Puerto Rico staff, handling the contract, payroll, FICA and FUTA withholding, Hacienda income tax withholding, and Law 4-2017 compliance, while you direct the work. Operational in days, no entity needed. Best for testing the market or hiring a small team.

Global Payroll

For when you already have a Puerto Rico entity, or want to consolidate payroll across several countries. You stay the legal employer; a specialist partner runs the monthly calculations across federal withholding, Hacienda’s territorial income tax, and Puerto Rico’s own unemployment insurance and disability insurance correctly.

Entity Formation (Corp. or LLC)

Your own Puerto Rico company, typically a for-profit corporation or an LLC, formed by filing a Certificate of Incorporation or Certificate of Formation with the Puerto Rico Department of State, not by notarial deed. Full control and a local presence, but you carry a registered agent requirement, annual filings, and, for qualifying activities, an Act 60 decree application if you want the reduced incentive rate. Right when the headcount and permanence justify it.

PEO Services

A co-employment model alongside your own Puerto Rico entity. Because Puerto Rico sits inside the US federal legal system, PEO co-employment here is far more established than in a genuinely foreign market, but the co-employer still has to run Hacienda’s territorial tax withholding and Law 4-2017 obligations correctly, not just federal ones. We will tell you honestly whether PEO or EOR is the better fit for your structure.

Puerto Rico at a glance

Currency

US dollar (USD). No exchange-rate risk to budget for, unlike most cross-border hires; a dollar figure you approve is the dollar figure that lands on payroll.

Minimum wage (2026)

USD 10.50 per hour, in force since 1 July 2024 under the Puerto Rico Minimum Wage Act. One flat territory-wide rate, no regional variation to track.

Employer costs

Employers pay FICA (7.65% combined Social Security and Medicare) and FUTA (0.6%, capped at the first USD 7,000 of wages) at the federal level, plus Puerto Rico’s own unemployment insurance (1.2% to 5.4% for established employers, 2.8% for new employers, also capped at USD 7,000) and non-occupational disability insurance (SINOT, up to 0.3%, capped at USD 9,000). Mandatory workers’ compensation runs through a single state-monopoly insurer (CFSE) rather than a flat percentage.

Leave & Notice

Puerto Rico is not at-will: dismissal requires statutory just cause under Law 80, with no fixed notice period but a statutory severance (‘mesada’) if just cause is not shown. Vacation accrues at 1.25 days per month worked and sick leave at 1 day per month, and a statutory Christmas bonus (‘bono de navidad’) is mandatory for qualifying employees every November-December.

Hiring in Puerto Rico: quick answers

The questions we are asked most about hiring in Puerto Rico.

An Employer of Record. Your hire can start in days, with a compliant Puerto Rico employment contract and correct Hacienda/FICA withholding from day one, and no entity to set up. It is the lowest-risk way to test the market or place a small team.
No. With an EOR you can employ people in Puerto Rico without your own company. You only need to incorporate when you are committing to a permanent, larger presence, or want to apply for an Act 60 incentive decree, and we will tell you honestly when that point arrives.
Because it looks like hiring in a US state and is not. Alongside federal FICA and FUTA, Hacienda runs a completely separate territorial income tax system, Law 4-2017 requires overtime after 8 hours in a day, not just 40 in a week, dismissal needs statutory just cause under Law 80, and a Christmas bonus is mandatory by law. None of it is a problem when a partner who already knows both systems is running it for you.
