PEO Services in Puerto Rico

A co-employment model for companies that want to share the employer relationship in Puerto Rico rather than hand it over entirely. Because Puerto Rico sits inside the US federal legal system, PEO co-employment here is genuinely well established, unlike in a foreign market; the part that still needs a specialist is Hacienda’s separate territorial tax system and Law 4-2017’s own obligations. We will tell you honestly whether PEO or an EOR fits, and place you with the right vetted partner.

What a PEO does in Puerto Rico

A Professional Employer Organisation works on a co-employment model. You and the PEO partner share the legal employer responsibilities for your Puerto Rico staff: you keep direction and day-to-day control, while the partner administers payroll, federal FICA/FUTA, Hacienda income tax withholding, and Puerto Rico’s own statutory benefits under a shared arrangement.

01

Shared employer role

You and the PEO partner share the legal employer responsibilities. You keep direction and control; they handle payroll, federal withholding, and Hacienda’s territorial tax system.

02

More direct control

PEO suits companies that want to retain more direct control of the employment relationship than a full EOR arrangement allows. Because Puerto Rico is a US jurisdiction, mature co-employment structures are genuinely available here.

03

Honest recommendation

For companies with no existing US presence, EOR is often simpler to start with. We will tell you honestly whether PEO genuinely fits your structure, or whether EOR serves you better.

How PEO works in Puerto Rico, step by step

From assessing the fit to a compliant co-employment arrangement.

01 — Assess the fit

We map your structure, headcount, and how much control you want to keep, and tell you honestly whether PEO or EOR serves you better. No product push.

02 — Set up co-employment

If PEO fits, we place you with a vetted Puerto Rico partner and structure the shared employer arrangement correctly.

03 — Onboard your people

Compliant Puerto Rico employment terms meeting federal law and Law 4-2017, with the administrative employer functions handled by the partner.

04 — Payroll & compliance

Federal FICA/FUTA, Hacienda income tax, and Puerto Rico’s own statutory filings handled monthly, while you keep day-to-day direction.

What PEO in Puerto Rico costs

As with EOR, two parts: the statutory cost of employment (a federal layer plus Puerto Rico’s own territorial layer) and the partner service fee.

Employer statutory cost

Federal FICA at 7.65% and FUTA at 0.6% (first USD 7,000 of wages), then Puerto Rico’s own layer on top: unemployment insurance ranging 1.2% to 5.4% depending on your rating, and disability insurance up to 0.3% (first USD 9,000), plus a classification-rated CFSE premium, all handled as part of the shared employer arrangement.

Minimum wage (2026)

USD 10.50 an hour since 1 July 2024, a single rate for the whole territory with nothing regional to track.

Income tax (employee)

A five-band scale running 0% to 33%, set by Hacienda’s own Internal Revenue Code rather than the mainland tables, withheld at source as part of the shared payroll administration.

PEO partner fee

A service fee for the co-employment administration. Under a shared employer arrangement, Puerto Rico’s federal and territorial layers still have to be administered correctly by someone. We benchmark across our vetted network, typically 15 to 25% below going direct.

The employer duties a Puerto Rico PEO shoulders

Whichever model you use, the underlying Puerto Rico rules are the same. Under a PEO arrangement, the administrative employer functions are handled for you.

Working time, leave & contracts

Compliant Puerto Rico employment contracts and working-time rules (standard 40-hour week, daily overtime after 8 hours under Law 4-2017, minimum 1.25 days’ vacation accrual per month worked). Federal FICA/FUTA and Hacienda territorial income tax withheld and filed correctly. Statutory benefits, the mandatory Christmas bonus, and just-cause protection applied properly.

Statutory protections & exits

The just-cause dismissal standard Puerto Rico employees carry under Law 80, and the statutory severance (‘mesada’) owed if just cause is not shown, all handled under the shared arrangement. The value is the same as with EOR: the compliance is handled by people who do it daily. The difference is simply how much of the employer role you keep.

What a PEO arrangement covers

The co-employment administration covers all of this, under one transparent fee.

Compliant contract

A compliant Puerto Rico employment contract meeting federal law and Law 4-2017, issued and maintained for you.

Payroll & filings

Monthly payroll run, with federal FICA/FUTA and Hacienda territorial income tax calculated, withheld, and filed each month.

Statutory benefits

All statutory benefits administered: vacation (1.25 days/month), sick leave (1 day/month), the mandatory Christmas bonus, and Law 80 just-cause protection.

Compliance & support

Ongoing HR compliance and a single point of contact, for the life of the engagement.

Your questions answered

Straight answers on how PEO co-employment works in Puerto Rico.

With an EOR, the partner is the sole legal employer of your Puerto Rico staff. With a PEO, you and the partner share the employer relationship, you keep more direct control, they handle the administration. Because Puerto Rico is a US jurisdiction, both models are genuinely well established here; the choice comes down to how much control you want and whether you have a Puerto Rico entity already.
PEO usually assumes you already have, or are willing to set up, a Puerto Rico entity. If you have none and want the fastest start, EOR is simpler. We assess your situation and recommend honestly.
It depends on the structure. Some co-employment arrangements assume or work alongside your own Puerto Rico entity. If you have no entity and want none, EOR is usually the cleaner route. We will confirm which applies to you.
The administrative employer functions, payroll, federal FICA/FUTA, Hacienda’s territorial income tax, and statutory filings, are handled by the partner. We make sure the arrangement is structured so responsibilities are clear and both federal and Puerto Rico law are met.
The statutory employer cost (7.65% FICA plus 0.6% FUTA federally, plus Puerto Rico’s own unemployment and disability insurance) plus a partner service fee for the co-employment administration. We benchmark across our network for pricing typically 15 to 25% below going direct.
Yes. These models sit on a spectrum and the right one changes as you grow, or as an Act 60 decree changes the economics. We advise on the path and manage transitions, EOR to PEO, or either to your own Puerto Rico corporation or LLC, as your presence develops.
