What an Employer of Record does for you in Serbia

An Employer of Record is a company that legally employs your Serbian staff on your behalf. You choose the person and direct their work day to day. The EOR is the legal employer on paper, which is what lets you build a team in Serbia without forming your own company.

In practice the EOR partner takes on everything that needs a Serbian legal entity and local expertise: a compliant employment contract under the Zakon o radu (Labour Law), monthly payroll with wage tax and social-security contributions withheld and paid to the Poreska uprava Republike Srbije (PURS) through a single combined return, employee registration with the Centralni registar obaveznog socijalnog osiguranja (CROSO) before their first day, statutory benefits and leave, and compliant onboarding and lawful exits under the closed list of grounds in the Zakon o radu, since Serbia is not at-will. You get a working team in days. The EOR carries the legal and compliance weight; you carry the commercial relationship. The only question worth spending time on is which partner is genuinely strong in Serbia, and that is the question we answer for you.

01

Legal employer, on paper

A compliant Serbian employment contract under the Zakon o radu, with all statutory terms correct from day one.

02

Compliant from day one

Monthly payroll, wage tax, and contributions to the Republicki fond za penzijsko i invalidsko osiguranje (PIO) and Republicki fond za zdravstveno osiguranje (RFZO), plus unemployment insurance, all withheld and filed with PURS in one combined return every pay run.

03

No entity required

Statutory benefits, annual leave, notice and severance under the Zakon o radu, and lawful onboarding and exits, without registering your own Drustvo sa ogranicenom odgovornoscu (DOO). You get a working team in days; the EOR carries the legal weight.

How it works: four steps to a compliant hire

From first call to a compliant Serbian hire at work, usually in days.

01 — Scope & quote

We map the role, salary, and start date, and come back with a clear all-in monthly cost. No guesswork, no hidden extras.

02 — Compliant contract

Your employment contract is drafted to Serbian standards by the partner, and we sanity-check the terms and pricing before you sign. Compliant from day one.

03 — Onboard in days

A correct Serbian contract is issued under the Zakon o radu, with all statutory terms from day one, and your hire is registered with CROSO before their first day.

04 — Payroll & compliance run

Wage tax, pension, health, and unemployment-insurance contributions calculated and withheld, payslips issued, and the combined PPP-PD return filed with PURS every pay run. You direct the work; the compliance just runs.

What EOR in Serbia costs

Two parts: the statutory cost of employing someone, and the EOR partner fee. In Serbia the entire statutory employer cost is calculated and filed through a single unified system, PURS, rather than several separate agencies. We make it transparent before you commit, so there are no surprises.

Employer social security

15.15% of gross salary: 10% PIO (pension and disability insurance) plus 5.15% health insurance (RFZO), both paid to PURS in one combined return. The employer pays no share of unemployment insurance, which funds the Nacionalna sluzba za zaposljavanje (NSZ) — that separate 0.75% sits entirely with the employee. Predictable and fully costed before you commit.

Termination & severance risk

Dismissal is only lawful on a closed list of grounds under Article 179, and most performance or conduct dismissals need a written warning first under Article 180. Severance applies only to redundancy, at a minimum of one-third of average monthly salary per year of service, and a dismissed employee has 60 days to challenge it in court.

Combined statutory rate

Employer and employee contributions together total 35.05% of gross salary across pension, health, and unemployment insurance. The employer’s 15.15% share is the number that lands on your invoice; the rest is withheld from the employee’s own pay, not billed to you.

EOR partner fee

A transparent per-employee monthly fee. We benchmark across our vetted network, typically 15 to 25% below going direct, and renegotiate for you at renewal.

Why run it through Bradford Jacobs

We know which EOR partners are genuinely strong in Serbia, by sector and by complexity. We place you with the right one, at pricing you will not get going direct, and stay on your side for the life of the relationship.

Independent, not a single provider

We are independent: we assess what you actually need, place you with the right vetted partner, secure pricing you will not get going direct, and stay on your side to escalate or renegotiate. You get advice, not a product pitch.

Pricing you can’t get direct

Serbia’s employer cost runs through a single unified system: PURS collects wage tax and all statutory social-security contributions together in one filing, which sounds simple but still leaves room for a partner to overprice a monthly fee. We benchmark across our partner network for rates typically 15 to 25% below going direct, and renegotiate on your behalf at renewal. Most companies do not know how much room there is to negotiate. We do.

  • 15-25% below direct
  • Network benchmarking
  • Renegotiated for you

Straight to the top when it matters

When something needs resolving, and in global employment it sometimes does, you come to us. We escalate directly, past the helpdesk, to people who can actually move it.

Built for conversion to your own entity

Most companies use EOR for 12 to 24 months, then move to their own Serbian DOO. We plan that crossover and manage the transition when the economics justify it.

Why an EOR is the fastest compliant way into Serbia

Two things catch foreign employers out in Serbia: the paperwork that still stands between a fast company registration and an operational, hiring-ready entity, and the risk of getting the Zakon o radu’s warning, notice, and severance rules wrong. An EOR removes both.

Working time, leave & contracts

Compliance handled under one national Labour Law. Serbian employment law requires mandatory PIO, health, and unemployment contributions, and dismissal that is only lawful on a closed list of statutory grounds under Article 179, with a written-warning procedure under Article 180 before most dismissals and statutory notice, rather than at-will termination. An EOR carries all of it correctly from day one, so a wrong assumption never becomes a liability.

Operational in days, not weeks

Registering a Serbian DOO through the Agencija za privredne registre (APR)’s eRegistracija portal is genuinely quick, often 3 to 5 business days for the resenje itself, but you still cannot legally employ anyone until the bank account, PIB tax number, and CROSO registration are all in place, and Serbia’s EU-candidate, not EU-member, status can add further documentation for a foreign-owned entity or a non-EU hire. An EOR removes that wait entirely: a compliant Serbian contract is issued and your hire starts in days. You prove the market first, then incorporate later only if the headcount justifies it. This is the real value of EOR in Serbia: speed into a market outside the EU’s single framework, with the compliance carried by an expert.

Everything your Serbian EOR covers

One transparent monthly fee per employee covers all of this. No hidden extras.

Compliant Serbian contract

A compliant Serbian employment contract under the Zakon o radu, issued and maintained for you.

Payroll, social security & health insurance

Monthly payroll run, with wage tax and PIO, health, and unemployment contributions calculated, withheld, and filed with PURS every pay run, including the annual contribution-base reset each January that your EOR partner tracks for you.

Statutory benefits

All statutory benefits administered: a minimum 20 days’ paid annual leave, public holidays, maternity and parental leave (state-funded, not employer-funded), and statutory notice on exit, which Serbia requires since it is not at-will. Employee social security runs 19.9% combined (14% PIO, 5.15% health insurance, 0.75% unemployment insurance), deducted from salary, not billed to you.

Compliance & support

Ongoing HR compliance and a single point of contact, for the life of the engagement.

Your questions answered

Straight answers on how Employer of Record works in Serbia.

Legally, your hire is employed by the Serbian EOR partner we place you with, which is what keeps you compliant without an entity. Day to day they work for you: you set the work, the goals, the relationship. You get the team; the partner carries the legal employer obligations.
Usually within days once the role and salary are agreed, with a compliant Serbian contract from day one. Compare that to registering and fully operationalising your own DOO, which needs a bank account, PIB tax number, and CROSO registration on top of the APR filing itself, during which you cannot legally employ anyone.
Predictable, at 15.15% of gross salary: 10% PIO (pension and disability) plus 5.15% health insurance; the employer pays no share of unemployment insurance. That is the number that lands on your invoice, the employee’s own share is withheld from their pay, not billed to you. Add the transparent EOR partner fee and you have your all-in cost, on top of a national minimum wage floor of RSD 371/hour.
Yes, when done properly. The EOR is a real Serbian legal employer meeting all Zakon o radu, PIO, RFZO, and PURS tax obligations. The risk is using an under-resourced partner, which is exactly why we place you with vetted partners and stay on your side.
The compliant contract, monthly payroll (wage tax and PIO, health, and unemployment-insurance withholding), employer contributions, statutory benefits and leave administration, and ongoing HR compliance. We give you one all-in monthly figure up front, with no hidden extras.
Yes, and most companies do once the headcount and permanence justify it. We manage the transition from EOR to your own Serbian DOO, and can support the incorporation itself. Most use EOR for 12 to 24 months first.
