A great market to hire in. A four-part employer-cost stack underneath.

Colombia is an OECD member with a diversified economy spanning oil, mining, agriculture, and financial services, plus one of the region’s fastest-growing nearshoring and BPO sectors, but employer costs run through four separate mandatory lines, pension, health, ARL, and parafiscales, that a company used to a single combined payroll tax can easily get wrong.

Latin America’s fourth-largest economy, and an OECD member

A diversified base in oil, mining, agriculture, and financial services sits alongside one of the region’s fastest-growing nearshoring and BPO sectors, but the peso (COP) floats freely against the dollar, so currency movement is a real, ongoing part of your cost planning.

02

Dismissal by a closed list of just-cause grounds

A single national Código Sustantivo del Trabajo, mandatory contributions split across pension, health, and ARL (workplace-risk insurance), plus parafiscales payroll taxes on top, and dismissal governed by a closed list of just-cause grounds mean your employment structure has to be chosen with care.

Four ways to hire in Colombia. Pick once, pick right.

Most businesses arrive having already decided, and often decided too quickly. Here is the honest version of each route. When one fits, the detailed guide is one click away.

Employer of Record

An EOR partner becomes the legal employer of your Colombian staff, handling the contract, payroll, statutory withholdings (income tax, pension, health, ARL), and Código Sustantivo del Trabajo compliance, while you direct the work. Operational in days, no entity needed. Best for testing the market or hiring a small team.

Global Payroll

For when you already have a Colombian entity, or want to consolidate payroll across several countries. You stay the legal employer; a specialist partner runs the monthly payroll, pension/health/ARL and parafiscal contributions, and DIAN withholding remittances correctly.

Entity Formation (S.A.S.)

Your own Colombian company, most commonly an S.A.S. (Sociedad por Acciones Simplificada), formed by an authenticated private document and Cámara de Comercio registration. Full control and a local presence, but you carry registration, tax, and ongoing filings. Right when the headcount and permanence justify it.

PEO Services

A co-employment model alongside your own Colombian entity. True PEO co-employment is far less established in Colombia than in the US, so for most companies EOR or managed payroll is the better fit. We will tell you honestly which one your situation calls for.

Colombia at a glance

Currency

Colombian peso (COP). Salaries are set and paid in COP, which floats freely against the dollar; if your budget lives in USD or EUR, exchange movement quietly changes your real cost.

Minimum wage (2026)

COP 1,750,905 per month (the SMMLV) for 2026, plus a mandatory transport subsidy for lower earners, one national rate set by government decree, no regional variation to track. The decree is under an ongoing Consejo de Estado challenge over its calculation method, but the figure itself remains in force.

Employer costs

Employers pay a four-part cost stack, not one flat percentage: employer pension 12%, employer health 8.5%, employer ARL workplace-risk insurance from 0.522% to 6.96% by risk class, and employer parafiscales of SENA 2% and ICBF 3%, plus Caja de Compensación Familiar 4%. The health and SENA/ICBF shares are largely exonerated for qualifying employers under Ley 1819 de 2016 on staff earning under 10x the minimum wage; Caja de Compensación is never exonerated.

Leave & Notice

Colombia has no general statutory notice requirement for ending an indefinite contract, but unjustified dismissal triggers a statutory indemnización (severance) instead. Minimum 15 working days’ paid annual leave, with 18 public holidays in 2026 under the Ley Emiliani.

Hiring in Colombia: quick answers

The questions we are asked most about hiring in Colombia.

An Employer of Record. Your hire can start in days, with a compliant Colombian employment contract from day one and no entity to set up. It is the lowest-risk way to test the market or place a small team.
No. With an EOR you can employ people in Colombia without your own company. You only need to incorporate when you are committing to a permanent, larger presence, and we will tell you honestly when that point arrives.
Four separate mandatory contribution lines (pension, health, ARL, and parafiscales) instead of one, each with its own rate and, in places, its own exemption rule, and severance calculations that depend on salary level and tenure rather than a flat formula. None of it is a problem when handled correctly, which is the point of getting the model right at the start.
We are independent: we assess what you actually need, place you with the right vetted partner, secure pricing you will not get going direct, and stay on your side to escalate or renegotiate. You get advice, not a product pitch.
