PEO Services in Chile

A co-employment model for companies that want to share the employer relationship in Chile rather than hand it over entirely. Worth knowing up front: true PEO co-employment is far less established in Chile than in the US, so we will tell you honestly whether PEO or an EOR genuinely fits, and place you with the right vetted partner.

What a PEO does in Chile

A Professional Employer Organisation works on a co-employment model. You and the PEO partner share the legal employer responsibilities for your Chilean staff: you keep direction and day-to-day control, while the partner administers payroll, income tax, AFP (Administradora de Fondos de Pensiones) pension contributions, health cover, and HR compliance under a shared arrangement.

01

Shared employer role

You and the PEO partner share the legal employer responsibilities. You keep direction and control; they handle payroll, income tax, AFP pension contributions, health cover, and HR administration.

02

More direct control

PEO suits companies that want to retain more direct control of the employment relationship than a full EOR arrangement allows. In Chile, true co-employment is uncommon: under a PEO, the client typically still carries some exposure for tracking obligations like the Ley 21.735 pension-reform phase-in, where an EOR absorbs that monitoring entirely.

03

Honest recommendation

For most companies hiring in Chile, EOR is simpler. We will tell you honestly whether PEO genuinely fits your structure, or whether EOR serves you better.

How PEO works in Chile, step by step

From assessing the fit to a compliant co-employment arrangement.

01 — Assess the fit

We map your structure, headcount, and how much control you want to keep, and tell you honestly whether PEO or EOR serves you better. No product push.

02 — Set up co-employment

If PEO fits, we place you with a vetted Chilean partner and structure the shared employer arrangement correctly.

03 — Onboard your people

Compliant Chilean employment terms under the Codigo del Trabajo, with the administrative employer functions handled by the partner.

04 — Payroll & compliance

Income tax, AFP pension contributions, and health cover handled and filed monthly, while you keep day-to-day direction.

What PEO in Chile costs

As with EOR, two parts: the statutory cost of employment (predictable, though split across several separately-capped contributions under Chile’s DC-based system) and the partner service fee.

Employer social security contributions

SIS disability/survivor cover (~1.5%, capped 90 UF), Seguro de Cesantia (2.4% for indefinite contracts, capped 135.2 UF), and work-accident cover from 0.90% under Ley 16.744, plus the new Ley 21.735 pension-reform contribution that is still phasing in year by year, all administered under the shared employer arrangement.

Minimum wage (2026)

CLP $553,553 per month for workers aged 18-65, effective 1 May 2026, one national rate with no regional variation to track.

Income tax (employee)

Progressive IUSC across 8 bands from 4% to 40%, exempt up to 13.5 UTM (Unidad Tributaria Monetaria) a month, Chile’s inflation-indexed tax unit, withheld at source as part of the shared payroll administration.

PEO partner fee

A service fee for the co-employment administration. Under a shared employer arrangement, Chile’s stack of AFP, Fonasa/Isapre, and unemployment-insurance contributions still has to be administered correctly by someone. We benchmark across our vetted network, typically 15 to 25% below going direct.

Why companies arrange Chilean PEO through us rather than going direct to a single provider.

We tell you if PEO fits your needs

We are independent: we assess what you actually need, place you with the right vetted partner, secure pricing you will not get going direct, and stay on your side to escalate or renegotiate. You get advice, not a product pitch.

Pricing you can’t get direct

Chile’s employer costs sit across several separately-capped contributions, from SIS and Seguro de Cesantia to the new pension-reform layer, and are simple to misjudge without local benchmarks. We benchmark across our vetted network for rates typically 15 to 25% below going direct, and renegotiate for you at renewal.

  • 15-25% below direct
  • Network benchmarking
  • Renegotiated for you

Straight to the top when it matters

When something needs resolving, and in global employment it sometimes does, you come to us. We escalate directly, past the helpdesk, to people who can actually move it.

Two decades of placements

Two decades placing and managing employment arrangements across global markets, with the local knowledge that keeps you ahead of Chile’s DC/AFP contribution structure, the Codigo del Trabajo’s dismissal grounds, and the Ley 21.735 pension-reform phase-in most in-house teams don’t track.

  • Right structure

We flex as your structure changes

PEO, EOR, and your own entity sit on a spectrum, and the right point shifts as you grow. We advise on the path and manage the moves, EOR to PEO, or either to your own Chilean SpA (Sociedad por Acciones), as your Chile presence develops.

The employer duties a Chilean PEO shoulders

Whichever model you use, the underlying Chilean rules are the same. Under a PEO arrangement, the administrative employer functions are handled for you, though under co-employment some monitoring responsibility can still sit with you, depending on how the arrangement is structured.

Contracts, payroll & remittances

Compliant employment contracts under the Codigo del Trabajo, enforced by the Direccion del Trabajo (DT). Income tax (IUSC), AFP pension contributions, Fonasa/Isapre health cover, and Mutualidad work-accident premiums calculated, withheld, and remitted correctly each month.

Statutory protections & exits

Statutory protections and dismissal, since Codigo del Trabajo dismissal is only lawful on the fixed grounds in Art. 159/160/161, with Art. 161 redundancy triggering severance of one month’s average pay per year of service (capped at 11 months) plus 30 days’ notice, all administered under the shared arrangement. What differs from EOR is where the compliance-monitoring burden sits: an EOR absorbs it entirely, while under PEO co-employment the client typically still carries some responsibility for tracking moving obligations, such as the Ley 21.735 pension-reform contribution, which steps up again on 1 August 2026 and keeps rising every August to 2033. We flag the changes; whether you or the partner has to act on them depends on how the arrangement is structured.

What a PEO arrangement covers

The co-employment administration covers all of this, under one transparent fee.

Compliant contract

A compliant Chilean employment contract under the Codigo del Trabajo, issued and maintained for you.

Payroll & filings

Monthly payroll run, with income tax, AFP pension contributions, and Fonasa/Isapre health cover calculated, withheld, and filed each month.

Statutory benefits

All statutory benefits administered under the Codigo del Trabajo: annual leave, sick pay, parental leave, notice and severance.

Compliance & support

Ongoing HR compliance, including tracking moving obligations like the Ley 21.735 phase-in, and a single point of contact for the life of the engagement.

Your questions answered

Straight answers on how PEO co-employment works in Chile.

With an EOR, the partner is the sole legal employer of your Chilean staff. With a PEO, you and the partner share the employer relationship: you keep more direct control, they handle the administration, though depending on the arrangement you can retain some exposure to obligations an EOR would absorb entirely. In Chile, true co-employment is uncommon, so EOR is the usual route; PEO suits specific structures.
For most businesses hiring in Chile, EOR is simpler. We will work with you and advise if the PEO model fits your structure or if EOR would suit you better.
It depends on the structure. Some co-employment arrangements assume or work alongside your own Chilean entity, typically an SpA. If you have no entity and want none, EOR is usually the cleaner route. We will confirm which applies to you.
The administrative employer functions, payroll, income tax, AFP contributions, Fonasa/Isapre health cover, and statutory filings, are handled by the partner. Depending on how the arrangement is structured, some monitoring responsibility, such as keeping pace with the Ley 21.735 pension-reform phase-in, can still sit with the client. We make sure responsibilities are clear and Chilean law is met.
The statutory employer contribution stack (SIS, Seguro de Cesantia, work-accident cover, and the phasing-in Ley 21.735 pension-reform layer) plus a partner service fee for the co-employment administration. We benchmark across our network for pricing typically 15 to 25% below going direct.
Yes. These models sit on a spectrum and the right one changes as you grow. We advise on the path and manage transitions, EOR to PEO, or either to your own Chilean SpA, as your Chile presence develops.
